Tierney was speeding at the time of the accident but expert evidence concluded that he would have been unable to anticipate the impact with Jess or to take avoiding action even if he had been travelling within the 20 mph speed. The court held that the defendant Barbour was negligent in permitting Jess to be on the road so as to cause the accident and in view of the expert evidence regarding the motorcyclist there would be no deduction of damages for contributory negligence.
